STATE BODY DID NOT WANT TO PAY

One of the most common and extremely complex problems that South Kazakhstani business faces is non-compliance with the deadlines for payment for the work performed under the contract.

Kazoilservice LLP, which last year won a tender for the construction of a trunk heating network in the city of Shymkent in the amount of KZT 1.348 billion, experienced the same situation. The customer was the Department of Housing and Utility Services of Shymkent city.

The object was movable for this year, and in early 2018 the company compiled an additional agreement to the contract for the amount of KZT 259 million. Work in the present year was also completed on time; there were no complaints towards quality. But this time the Department of Housing and Utility Services detained payments for the work performed. The entrepreneur used whatever methods are available, but the state body ignored all payment terms under various pretences, including lack of money.

Time passed, but the state body didn't hasten to fulfill the payment obligations. At the beginning of the year, the company sent a complaint to the akim of the city of Shymkent, its deputy and the Head of the Housing and Utility Services Department with a demand to pay for the work performed. Despite this, the entrepreneur did not hear back. Having not received a positive response from the city authorities, the company management turned to the Chamber of Entrepreneurs of the SKO with a request to restore legitimate interests in the pre-trial order.

Having considered the arguments of the company, the experts of the Chamber of Entrepreneurs sent a motivated letter to the head of the Housing and Utility Services Department of the Akimat of Shymkent with the demand to eliminate the violations.

"As a result of all the efforts that have been made, the rights of the companies that have performed work have been restored, and on March 20 of the present year the obligation to pay for the work performed was fully implemented," - Madikhan Tajibayev, an expert of the South Kazakhstan Chamber of Entrepreneurs said.
