Adjusted calculation for 12 million tenge
Lawyers of the legal unit of the regional Chamber upheld the rights of the entrepreneur
Individual entrepreneur Olga Kortunova addressed to the Chamber with a request to assist in the appeal of inspections results of the Department of the Committee on Regulation of Natural Monopolies and Protection of Competition of WKR, which found violations of the antimonopoly legislation during sale of granulated sugar.
The legal unit of the Chamber assisted in the preparation of the complaint to the court on the order of the Department approving the conclusion by the results of the inspection and objection to the decision to bring IP Kortunova O.N. to justice. She obtained legal support in court. The Chamber also directed analytical reference with its position to the Department. In reviewing materials in court, the Department agreed with the above arguments, and made adjustments to the approved report. After that, previously determined revenue by the Department from monopolistic activities in the amount of 223 210 759 tenge was reduced to 2.64 million, and previously defined monopoly revenue by the Department in the amount of 3,040,685 tenge, which is subject for state collection to the budget, has been completely eliminated.
By originally drawn up conclusion of the Department, penalty in the amount of 3% of the income received as a result of monopolistic activities in the amount of 9,362,685 tenge, plus 3,040,685 tenge monopoly revenue were imposed on IP Kortunova. But after adjustment produced by the Department, the Administrative Court of Uralsk charged IP Kortunova O.N. with a fine in the amount of 79 200 tenge.
Thus, the rights of IP Kortunova totaling 12,324,170 tenge were reserved.
"When I got on the conclusion of the Department about bringing me to justice with a fine, I did not know where to go. I was confused. Too exorbitant fines, - said Olga Kortunova. - I have always heard about the Chamber of Entrepreneurs, and then decided to appeal. I do not expect that the assistance would be so real and tangible. I am very grateful to the lawyers".
