HEAD OF THE ARCHITECTURE AND URBAN PLANNING DEPARTMENT OF TALDYKORGAN SUBJECTED TO DISCIPLINARY LIABILITY
The public authority ignored the appeal of the entrepreneur for more than three months.
In June 2018, the entrepreneur Zhanar Imangaliyeva appealed to the Architecture and Urban Planning Department of Taldykorgan to transfer the apartment from the residential property to a commercial one, namely pharmacy. However, the Department violated the standard of public services and ignored the appeal.
After a long wait for a response from the Department, the businesswoman turned to the Chamber of Entrepreneurs to seek legal assistance. In order to determine the legality of the decision of the Architecture and Urban Planning Department, the experts of the Chamber sent a letter to the regional department of the Agency for Civil Service and Anti-Corruption. In turn, the representatives of the Department conducted an unscheduled inspection in the office.
“The Committee for Construction and Housing and Public Utilities of the Ministry for Investment and Development of the Republic of Kazakhstan recognized as unjustified the response of the head of the Department, who, according to paragraph 1, of Article 60 of the Law “On Architectural, Town-planning and Construction Activity in the Republic of Kazakhstan”, refused to change the functional purpose of the residential property for commercial facility. In this regard, the department head M. Anarkulov, according to paragraph 2, of Article 465 of the Code “On Administrative Offenses” was brought to administrative responsibility,” the Agency for Civil Service and Anti-Corruption of the Almaty region informed atameken.kz.
However, only after the intervention of the Chamber of Entrepreneurs and the Agency for Civil Service and Anti-Corruption the representatives of the department responded to the appeal of the businesswoman and did it 115 days after the receipt of the appeal. So, to sum things up, the Architecture and Urban Planning Department issued the decision on rejection the appeal a few months later after receiving the application, while according to the state service provision standard, this application must be dealt with within 15 working days. As a result, the leading specialist of the Department subjected to disciplinary penalty.
